The “Marks”
There is more involved in securing your trademarks than meets the eye! Sure, we know you want your mark to look good; but avoiding deficiencies and challenges are just as important. It takes an experienced Trademark Attorney to be able to foresee any pitfalls such as possible conflicting trademarks, before you make your application to the United States Trademark and Patent Office. Filing your trademark with USTPO does not guarantee a registered mark; however, we can advise you on the likelihood of success based on our extensive experience.
Federal Compliance
Your Uniform Franchise Disclosure Document (UFDD) and your Franchise Agreement are the most important documents you will need. Your documents must comply not only with the Federal Trade Commission; but each registration state has its own requirements as well. From the beginning, by having an experienced franchise registration attorney draft these documents for you; you have a better chance of getting approved the first time around, thus saving you time, aggravation and money!
State Compliance
There are 25 states that require both initial registration and annual renewals. There are 10 states that regulate franchise operations under their Business Opportunity Regulations or Practices Acts and require additional filing. Other states require conformity to their statutes; but do not require any filing. We will make sure your Franchise is in compliance under these individual state regulatory laws as well eliminating any “guess work” you may have about compliance.
Financial Compliance
Your financial status is an important piece of your financial foundation, and this is where your decision on the type of corporate formation comes into the picture. We will assist you or your accounting firm on the proper financial statements and/or escrow accounts necessary in the formation of your Franchise and in the drafting of your UFDD. Or, we will be happy to recommend someone to assist you in the audit of your financial statements.
